This question has been added to the pre-exam questionnaire for the FDIC. Other major issues that rose to the top were how examiners would be evaluating carry-over debt on agriculture loans, the vagueness of flood insurance criteria and military lending guidelines. The committee traveled down the street to meet with a panel from the FDIC led by Vice Chairman Tom Hoenig, which included much discussion based on the questions posed from Kansas bankers. Among the issues discussed was the predicament of asking banks for communications with bank attorneys during an examination, the lack of guidance from FEMA on flood insurance, and the treatment of carryover operating debt for agricultural customers. The group later met with a panel from the CFPB that was led by Senior Advisor Jennifer Stockett. There was much discussion about the newly proposed rules to regulate payday lending and further amendments to the the integrated mortgage disclosure rules. The day concluded with a session at the OCC in a round table format that included Senior Deputy Comptroller for Bank Supervision Grace Daily, Senior Deputy Comptroller for Compliance Risk Grovetta Gardineer, Deputy Chief Counsel Karen Solomon, and Deputy Comptroller for Thrift Supervision Michael Brickman. Much of the discussion focused on the new CECL rules and the OCC’s guidance as well as a question from the group giving insight into what keeps regulators awake at night. The nearly unanimous answer was cybersecurity concerns. Visits to Capitol Hill went very well with Senators Pat Roberts and Jerry Moran, each of whom met with the group for up to an hour and took many questions. There was more openness to considering an adjustment to applicable tax rates on agriculture loans to better compete with Farm Credit. Following lunch, the committee broke into groups and met with their delegate from the House of Representatives. All four Congressional representatives made themselves available – even if for a brief moment – between recording votes on the floor.
