Ballentine wrapped up his presentation with discussion on the Department of Labor’s overtime rule. There are two bills pending that would appeal or adjust this ruling with Republican support only. The ABA visit included reports from key ABA staff over the equal tax treatment involving credit unions and Farm Credit. Steve Apodaca, SVP, Agriculture & Rural Banking, reported on the hearings held by the House and Senate Agricultural Committees that have been held on Capitol Hill regarding the Farm Credit System. He also discussed the mechanics of the System and what it would look like with a level playing field. Apodaca also reported on the nationwide shortage of agriculture and commercial loan appraisers, indicating that the changes in qualifications needed may not be acquired through legislation but rather through one of the oversight committees for the appraisal industry. Doug Johnson, SVP/Sr. Advisor Risk Management, provided an update on data breach and data security. Bob Davis, EVP, Mortgage Markets, Financial Management, & Public Policy, discussed housing reform and the possibility of the CFPB reopening rulemaking for TRID to address the conflicts. Some of the considerations are also to have written FAQ’s to provide a formal digest rather than guidance through webinars only. He also provided an update on CECL and a movement to have small loans exempt from QM rules.
